By accessing or using DriftNote ("the Service"), operated by DriftNote ("we", "us", or "our") at driftnote.net, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using any part of the Service, you confirm that you are at least 16 years old and have the legal capacity to enter into a binding agreement.
DriftNote is an AI-powered podcast summarisation tool. Users submit Spotify podcast episode links, and the Service retrieves episode transcripts, processes them using Google's Gemini AI, and returns structured notes. Users may optionally connect their Notion workspace to have summaries automatically saved there.
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of it at any time with or without notice.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.
You may not share your account with others or use another person's account without their permission.
The Service is offered under two tiers:
We reserve the right to change plan features, limits, and pricing at any time. Existing subscribers will be given reasonable notice of any price changes before they take effect.
Paid subscriptions are billed in advance on a monthly basis. All payments are processed securely by Stripe. By providing payment information, you authorise us to charge your payment method for the applicable subscription fee.
Subscriptions automatically renew unless cancelled before the end of the current billing period. You can cancel at any time from your account settings. Upon cancellation, your Pro access continues until the end of the current billing period — no partial refunds are issued for unused time.
If a payment fails, we may suspend your Pro access until payment is resolved. All prices are displayed in US dollars unless otherwise stated.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
The Service, including its design, code, branding, and all content produced by DriftNote, is the exclusive property of DriftNote and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written consent.
Summaries generated by the Service are produced using AI based on podcast content you submit. You retain ownership of any data you input, and you are granted a personal, non-exclusive licence to use, download, and share the summaries generated for your own private or professional use. You may not resell or commercially redistribute AI-generated summaries without our permission.
The Service integrates with third-party platforms including Google Gemini (AI processing), Notion (note storage), Stripe (payments), Supabase (authentication and database), PodcastIndex, Spotify, Apple iTunes, Cloudflare, and Vercel. Your use of these integrations is subject to the respective third parties' terms and privacy policies.
We are not responsible for the availability, accuracy, or practices of any third-party service. Connecting a third-party integration (such as Notion) is entirely optional and at your discretion.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
AI-generated summaries may contain inaccuracies, omissions, or errors. They are provided for informational purposes only and should not be relied upon as a complete or authoritative record of any podcast episode. We do not guarantee the accuracy, completeness, or quality of any summary.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
To the fullest extent permitted by applicable law, DriftNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the event giving rise to the claim, or (b) $10 USD.
You may stop using the Service at any time. You may delete your account by contacting us at contact@driftnote.net. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you by email or by displaying a notice in the Service.
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
